LPS Mental Health Conservatorships

LPS conservatorships in California, established under the Lanterman-Petris-Short Act, allow a court to appoint a conservator for individuals deemed "gravely disabled" due to a mental health disorder. These conservatorships are intended for people who cannot meet basic needs like food, clothing, or shelter and are unwilling or unable to accept voluntary treatment. Initiated often after an involuntary psychiatric hold (e.g., 5150), they authorize the conservator to make decisions about the individual's care, including treatment and living arrangements, often in secure facilities. Temporary conservatorships last up to 30 days, while permanent ones last up to a year and can be renewed. In criminal cases, LPS conservatorships can be used when a defendant is found incompetent to stand trial, ensuring they receive treatment with the goal of restoring competency.
